Małgorzata Manowska, acting as the First President of the Supreme Court, does not want to hand over the files of an important case regarding the status of the neo-judges of the Supreme Court to the legal judges of the Supreme Court. This is the third case blocked by Manowska in which the CJEU has issued a ruling

Piotr Prusinowski, President of the Labour and Social Security Chamber, has issued a poignant and emotional statement explaining why he will not adjudicate with neo-judges of the Supreme Court. In it, he calls on the neo-judges to come to their senses and warns against dictatorship.

The reorganisation planned for January is to give the neo-judges full control over the Civil Chamber. Its result will be that old judges will lose the managerial positions of the divisions and neo-judges will take their place. The names in line for ‘promotion’ include Kamil Zaradkiewicz.

President Andrzej Duda has issued a regulation silencing the old judges of the Supreme Court and restricting their initiative.  In exchange, it strengthens the position of President Manowska and the new judges. It also sanctions the principle of non-disclosure of cases in the Supreme Court. 

In precedent-setting judgments, the Supreme Administrative Court undermined the validity of the selection of the new Supreme Court judges. It ruled that the recruitment to the Supreme Court was defective from the outset, while the new NCJ, which gave the nominations, was dependent on the politicians. The Supreme Administrative Court’s judgments have now opened the door to declaring the new Supreme Court judges illegal.

President Andrzej Duda has submitted a bill on the Supreme Court to the Sejm that would give him the right to introduce his ‘commissioners’, acting presidents, to the old chambers of the Supreme Court. Lawyers are concerned that this could be a way of blocking an important matter in the CJEU regarding the legality of the appointment of new Supreme Court judges.

The Supreme Court judges did not choose candidates to be Małgorzata Gersdorf’s successor for the second day in a row. On Saturday, the acting president of the Supreme Court, Kamil Zaradkiewicz, again rejected all the motions of the judges of the ‘old’ Supreme Court and took the floor away from them. And when the result of valid voting was not in line with his thoughts, he stopped the session.
