Ziobro’s ‘enforcer’ strikes at Gersdorf. For the resolution of the three chambers of the Supreme Court on neo-judges and the neo-NCJ
Minister Ziobro’s people step up the repression of independent judges. Piotr Schab has just taken steps against former First President of the Supreme Court Małgorzata Gersdorf for allowing legal Supreme Court judges to pass a historic resolution undermining the legality of the neo-NCJ and the Disciplinary Chamber.
She has been adjudicating in the criminal division for 30 years. Ziobro’s man transferred her to the labour division. ‘They showed contempt’
‘This is a show of contempt for the work we do. The authorities are proving that they can do anything they like with a judge,’ commented Judge Marzanna Piekarska-Drążek of the Court of Appeal in Warsaw in an interview with Onet on the decision to move her to the labour and social insurance division after 30 years of adjudicating in the criminal division. On Monday, after returning from her holiday, she found out that she is to work in a completely different place from next week.
Schab, Ziobro’s ‘enforcer’, confirms: the repressions in the court of appeal are for applying EU law
Piotr Schab, president of the Court of Appeal in Warsaw, confirmed that the transfer of two judges to different divisions is a penalty for applying judgments of the ECtHR and the CJEU. Schab and his deputy, Radzik, will face criminal liability in the future for the repressions.
Attack of the disciplinary commissioners on Judge Żurek. ‘They are ridiculing themselves’
Judge Waldemar Żurek heard as many as 64 disciplinary charges today from Disciplinary Commissioners Piotr Schab and Michał Lasota. They are also not ruling out notifying the public prosecutor’s office because they claim that Żurek committed a ‘falsification of judgments’. This applies to the dates on some of the court’s decisions being the same as the dates on which Żurek was present at NCJ meetings in Warsaw. Meanwhile, he adjudicates in Kraków.
Judge Piotr Gąciarek was suspended by Ziobro’s nominee for implementing EU law
Disciplinary commissioner Piotr Schab suspended judge Piotr Gąciarek for a month for a declaration made a few days earlier in which Gąciarek refused to adjudicate in a bench with a judge promoted by the new, political National Council of the Judiciary. Gąciarek is the second judge recently suspended for refusing to adjudicate with a neo-judge in the performance of the July judgment of the CJEU and the ECtHR.

Independent Judge Piotr Gąciarek from Warsaw has been removed from adjudicating in important criminal cases. He will be assigned to a quieter division in the court. This is a demotion for him and a punishment for his bold speech in court in defence of the free courts. Ziobro’s disciplinary commissioner is also taking an interest in Gąciarek
Ziobro’s faithful soldier becomes president of the largest court in Poland
The chief disciplinary commissioner, Piotr Schab, has been nominated to the office of president of the Regional Court in Warsaw. Schab is known for prosecuting independent judges. If this information is officially confirmed, it will mean a stricter course for Poland’s largest court.

Increasingly more people are involved in prosecuting and repressing independent judges. Not only have other judges joined Schab’s, Radzik’s and Lasota’s team of disciplinary commissioners, but so have assistants. The costs of employing them are also increasing, because they spent PLN 156,000 on travel and accommodation alone last year.
