Duda: Legal chaos threatens Poland
Andrzej Duda has disagreed from the very beginning with the changes introduced in the Prosecutor General’s Office by Minister of Justice Adam Bodnar.
Lex Tusk is violating EU law, the European Commission has to intervene [analysis]
The commission investigating Russian influence, seen as a tool against Donald Tusk and the ‘enemies’ of PiS, could result in the blocking of EU funds for Poland.
The President promoted Ziobro’s people and judges from the Kasta/Antykasta group. This is what the compromise with the EU looks like
The President has given high promotions to judges associated with Minister Ziobro, members of the illegal NCJ and the partner of the head of the neo-NCJ. At the same time, independent judges are experiencing further repressions. This shows how the President and the PiS authorities will implement the compromise with the EU in practice.
President Duda attacks the judges again: they want power. Nonsense, the judges are defending the Constitution and EU law
President Andrzej Duda attacked the organizations of judges for challenging the Polish National Recovery Plan before the CJEU. According to the President, judges want to govern. However, Duda does not understand how the separation of powers works and does not know that judges can protest and express their opinions.
If Brussels buys Duda’s offer, it will turn judges into fools and condemn Poland to a drift towards dictatorship
The European Commission is to decide whether to unfreeze billions for Poland from the EU’s Reconstruction Fund. It should not ‘buy’ President Duda’s or the Law and Justice party’s (PiS’s) offer. It needs to demand the full restoration of the rule of law. Otherwise, it will condemn the courts to ultimate destruction, reward ‘sly judges’ and antagonise the judicial community.
Liquidation of the Disciplinary Chamber. Duda’s and Manowska’s bill contains traps
The Disciplinary Commissioner will be able to prosecute a judge who interprets that the Catholic Church is liable for the crime of paedophilia of its subordinates. And this is just one of the possible dangers contained in the presidential bill.
President gives an excuse
The reform of disciplinary proceedings is to involve the – repeatedly announced – liquidation of the Disciplinary Chamber and the establishment of a new Chamber, the Professional Liability Chamber. The judges of what has been the Disciplinary Chamber to date are to be parcelled out to other chambers, which means they will be dominated by neo-judges. Well, unless they choose to retire – on very financially-attractive terms.
New regulation to annihilate the ‘old’ Supreme Court and silence judges
President Andrzej Duda has issued a regulation silencing the old judges of the Supreme Court and restricting their initiative. In exchange, it strengthens the position of President Manowska and the new judges. It also sanctions the principle of non-disclosure of cases in the Supreme Court.
After the judgment of the Supreme Administrative Court. The nominations for the new Supreme Court judges, including President Manowska, are invalid
In precedent-setting judgments, the Supreme Administrative Court undermined the validity of the selection of the new Supreme Court judges. It ruled that the recruitment to the Supreme Court was defective from the outset, while the new NCJ, which gave the nominations, was dependent on the politicians. The Supreme Administrative Court’s judgments have now opened the door to declaring the new Supreme Court judges illegal.
The amendment to the Act on the Supreme Court contains dangerous solutions
President Andrzej Duda wants to ensure he has the right to appoint commissioners to temporarily take over the ‘old’ chambers of the Supreme Court. And that the first president will be able to appoint the benches in cases initiated by her.
