Duda: Legal chaos threatens Poland
Andrzej Duda has disagreed from the very beginning with the changes introduced in the Prosecutor General's Office by Minister of Justice Adam Bodnar.
The actions of both the Prime Minister and the Prosecutor General (Minister of Justice) are in stark contradiction to the law in force in the Republic of Poland, and thus constitute a breach of the oath taken in accordance with Article 151 of the Constitution,” writes the President to Donald Tusk.
Andrzej Duda has disagreed from the very beginning with the changes introduced in the Prosecutor General’s Office by Minister of Justice Adam Bodnar. On March 21, 2024, the President published the letter he sent to Prime Minister Donald Tusk on March 19.
Andrzej Duda writes:
‘The position of the Prosecutor General is held by Mr. Dariusz Barski, who has not been removed by the Prime Minister in accordance with Article 14, paragraph 1 of the Prosecution Law.’
Duda’s concern is that according to the law, the dismissal of a prosecutor requires the consent of the President. However, Minister of Justice Adam Bodnar argues that Dariusz Barski was not effectively appointed to this position at all.

According to Andrzej Duda, the changes in the prosecutor’s office are illegal. He reminds that on January 15, he filed a request with the Constitutional Tribunal for the ‘resolution of a competency dispute’ between the President, the Prime Minister, and the Prosecutor General. The President believes that until a decision is made by the Constitutional Tribunal, the Prosecutor General has no right to take actions in the prosecutor’s office.
Duda also claims that Dariusz Korneluk has been illegally appointed as the new Prosecutor General. It was Korneluk who won the competition for the Prosecutor General announced by Adam Bodnar in February.”
