The Law and Justice (PiS) party chairman promised a final crackdown on the courts at an election rally. In practice, this will mean liquidating the current courts, removing independent judges from them and appointing ‘their own.’ If PiS wins the elections and does this, it will result in a major clash with the EU.

‘We have really demonstrated maximum goodwill. From the point of view of the treaties, we are under no obligation to listen to the Union on the justice system. None whatsoever,’ said Jarosław Kaczyński, when asked about the ‘milestones’ in the National Recovery Plan during a successive pre-election meeting.

The Hungarian and Polish governments are united in defending their autocratizing political models, whatever it takes politically. However, there is also a significant difference between Poland and Hungary. While Poland is largely free from large-scale, systemic corruption plaguing EU funds, the Hungarian regime’s political-economic model is based on state-led, centralized corruption structures and the deliberate misuse of EU funds.

Jarosław Kaczyński: “there is indeed a problem in Poland with the rule of law, but the main sources of this state of affairs are court judgments contra legem. It is our duty to ensure that these judgments made in conflict with the law are swiftly revoked and the judges who issue them held accountable on disciplinary charges and, consequently, removed from the profession.”

The Commissioner for Human Rights Adam Bodnar’s five-year term of office ends on 9 September. It is likely that PiS will treat the election of the new Commissioner as a show of hegemony and a symbolic retaliation against Bodnar as well as lawyers and civil society activists involved in the defence of the rule of law, which means there will be a ‘trench warfare’ between the Sejm and Senate in the autumn
