New regulation to annihilate the ‘old’ Supreme Court and silence judges

President Andrzej Duda has issued a regulation silencing the old judges of the Supreme Court and restricting their initiative.  In exchange, it strengthens the position of President Manowska and the new judges. It also sanctions the principle of non-disclosure of cases in the Supreme Court.

Scandalous attack by the political NCJ on the court in Bydgoszcz and Judge Juszczyszyn’s lawyer

The new NCJ, which is supposed to defend the independence of the courts, has itself attacked the court in Bydgoszcz for reinstating Judge Paweł Juszczyszyn. It has also attacked the judge’s lawyer, who is demanding that the First President of the Supreme Court enforce the ruling in Juszczyszyn’s case.

After the judgment of the Supreme Administrative Court. The nominations for the new Supreme Court judges, including President Manowska, are invalid

In precedent-setting judgments, the Supreme Administrative Court undermined the validity of the selection of the new Supreme Court judges. It ruled that the recruitment to the Supreme Court was defective from the outset, while the new NCJ, which gave the nominations, was dependent on the politicians. The Supreme Administrative Court’s judgments have now opened the door to declaring the new Supreme Court judges illegal.

After Tuleya, the Disciplinary Chamber is taking on Prof. Wróbel from the Supreme Court

The illegal Disciplinary Chamber will decide as early as on 6 May whether to lift Professor Włodzimierz Wróbel’s immunity and allow him to be prosecuted, after he ran for the office of president of the Supreme Court. The decision will be made by former prosecutors associated with Ziobro and a supporter of the PiS government

National Prosecutor’s Office to raid the Supreme Court

The National Prosecutor’s Office is about to ambush the old, legal Supreme Court. It has demanded that the Criminal Chamber hand over the files of 25 cases because it is conducting a political investigation of the Supreme Court. The chairman of the Criminal Chamber, Michał Laskowski, a dozen or so judges from that Chamber and even former Supreme Court President Gersdorf would be threatened with criminal charges.

Prosecutor’s office takes over Supreme Court files. The start of an ‘offensive against the judges’?

National Prosecutor Bogdan Święczkowski has demanded that the Supreme Court hand over the files of cases heard by the Criminal Chamber. They are needed by the prosecutors from the internal affairs department of the National Prosecutor’s Office. This is a special unit that was supposed to combat pathologies in the judiciary, and has recently been involved in prosecuting judges

The National Prosecutor’s Office has unexpectedly asked the illegal Disciplinary Chamber to lift the immunity of three judges of the Criminal Chamber of the Supreme Court. The list includes Professor Włodzimierz Wróbel, a fierce critic of the ‘good change’ in the courts and Małgorzata Manowska’s counter-candidate for the office of president of the Supreme Court. The prosecutor’s office wants to charge them for the mistakes of the employees of the Supreme Court.

First President of the Supreme Court Malgorzata Manowska is attempting to remove four ‘old’ judges from cases in which questions were asked of the CJEU. ‘The groundless request is a pretext for eliminating me from the case,’ believes Judge Krzysztof Rączka.

President Duda wants new ‘commissioners’ in the Supreme Court. To withdraw the question requiring a preliminary ruling of the CJEU

President Andrzej Duda has submitted a bill on the Supreme Court to the Sejm that would give him the right to introduce his ‘commissioners’, acting presidents, to the old chambers of the Supreme Court. Lawyers are concerned that this could be a way of blocking an important matter in the CJEU regarding the legality of the appointment of new Supreme Court judges.
