The president of the Court of Appeal in Warsaw, Piotr Schab, does not respect the law, while there is interference in final judgments to the benefit of the prosecutor’s office in the court he manages – as arises from the declaration of 43 judges of that court.

Disciplinary cases are pending for Judges Anna Głowacka and Edyta Barańska from Kraków for implementing ECtHR and CJEU judgments. They are being prosecuted by Zbigniew Ziobro’s people – Piotr Schab and Przemysław Radzik. Similarly, the latter are deliberately breaching the CJEU’s ruling

The prosecutor of independent judges, Przemysław Radzik, is threatening Judge Wojciech Maczuga with disciplinary action for applying European law. Radzik’s action is a further attack on the shaky compromise between PiS and the European Commission over billions from the NRRP

This is a great campaign in defence of Judge Joanna Knobel, who acquitted 32 people protesting in Poznań cathedral. The right wing, Minister Ziobro and the neo-NCJ attacked the judge for this judgment. But she is being fully backed by judges and lawyers throughout Poland, who signed a letter in her defence.

The new presidents of the Poznań courts had not been promoted for years; they had low appraisals, they made mistakes that were sometimes so embarrassing as sentencing innocent people. Now Ziobro is giving them a huge amount of power. The judges have been stirred up.

‘It’s beneath me to comment on Ziobro’s words that “officials from Brussels want to incapacitate Poland”,’ says Supreme Court Judge Krzysztof Rączka.

The President has given high promotions to judges associated with Minister Ziobro, members of the illegal NCJ and the partner of the head of the neo-NCJ. At the same time, independent judges are experiencing further repressions. This shows how the President and the PiS authorities will implement the compromise with the EU in practice.

 Igor Tuleya, a symbol of the free courts, filed a complaint with the ECtHR because the court presidents nominated by Ziobro are not implementing the judgments ordering his return to work. Tuleya will also request a fine of PLN 15,000 and the arrest of the minister’s nominee

The declaration of the 30 judges of the Supreme Court is a strong message addressed to all judges in Poland. The judges of the Supreme Court show that the judgments of the CJEU and the ECtHR and the historic resolution of the full panel of the Supreme Court that challenged the neo-NCJ and the neo-judges it nominated should be implemented.
