An absurd disciplinary charge has been pressed against former Supreme Court President Małgorzata Gersdorf for the legal Supreme Court judges issuing a historic resolution. The charge was raised against her by Piotr Schab, Ziobro’s man and President Duda’s commissioner for special affairs.

Piotr Schab, president of the Court of Appeal in Warsaw, confirmed that the transfer of two judges to different divisions is a penalty for applying judgments of the ECtHR and the CJEU. Schab and his deputy, Radzik, will face criminal liability in the future for the repressions.

Disciplinary commissioner Piotr Schab suspended judge Piotr Gąciarek for a month for a declaration made a few days earlier in which Gąciarek refused to adjudicate in a bench with a judge promoted by the new, political National Council of the Judiciary. Gąciarek is the second judge recently suspended for refusing to adjudicate with a neo-judge in the performance of the July judgment of the CJEU and the ECtHR.

Increasingly more people are involved in prosecuting and repressing independent judges. Not only have other judges joined Schab’s, Radzik’s and Lasota’s team of disciplinary commissioners, but so have assistants. The costs of employing them are also increasing, because they spent PLN 156,000 on travel and accommodation alone last year.

The Minister of Justice Zbigniew Ziobro’s disciplinary commissioner is prosecuting Krzysztof Parchimowicz for criticizing the management of the prosecution service on Twitter. He is also under threat of disciplinary action for supporting a colleague who was being prosecuted.

“The involvement of a judge, who speaks up on such public matters related to the rule of law is certainly not a political voice.” Prof. Marek Safjan, judge of the Court of Justice of the EU and retired judge of the Constitutional Tribunal, comments on the reports that the disciplinary commissioners want to prosecute 1,200 judges throughout Poland who signed the letter to the OSCE asking it to oversee the postal presidential elections, which were to be held in May 2020.

Przemysław Radzik’s letter to the local disciplinary commissioners at the district and appellate courts shows that Ziobro’s people are heading for a total attack on defiant judges. This is because such record-breaking disciplinary action is absurd and will be extensively commented on in the EU.
