Position of the Stefan Batory Foundation Legal Expert Group on the procedure for selecting Supreme Court judges
Unconstitutional selection panel, unconstitutional and unreliable selection procedure and lacking candidates taking part in the gross betrayal of the values underlying legal professions.
- Selection procedure for Supreme Court (SN) is invalid since it lacks signature (countersignature) by the Prime Minister;
- Actions by National Judiciary Council (itself appointed in violation of the Consitution) in the selection procedure of SN judges indicate that it is highly politicised, while threatening judicial independence;
- Many of the SN candidates recommended by the Council do not guarantee that the constitutional and statutory tasks of a Supreme Court judge will be performed properly;
- Candidates’ involvement in actions that undermine the foundations of the lawful state is a gross betrayal of the values underlying their professions as academics, judges, lawyers, legal advisors, notaries and prosecutors.
