Position of the Stefan Batory Foundation Legal Expert Group on the amendment to the law on the Supreme Court adopted on 21 November 2018
Batory Foundation Legal Expert Group concludes that nothwitstanding the positive direction of the Amendment Act on the Supreme Court, it is primarily an instrument to obtain desired effect in the negotiations with the EU.
- While recognising positive direction of the recent changes in regulations concerning Supreme Court, legal experts of Batory Foundation highlight that the legislator withdrawing some of the unconstitutional changes to the Supreme Court does not restore the rule of law in Poland;
- They challenge the process of new act adoption as violation of the basic principles of lawmaking in a democracy, its unethical provisions, unconstitutionality of legislative branch interference with judiciary and closing of the court path.
